How to Protect Your Brand?

Protecting brand

A brand is a name, a logo, a slogan, a term or maybe a feature that distinguishes a product or service from any other business which may be providing similar services. Businesses spend a lot of time, energy and too much money to build a brand creating a name or logo that captures the true essence of its product or service. When businesses have got such a strong brand, it’s worth protecting it.

With the increased expansion of businesses and higher advertising cost, the need for Brand protection has become a necessity.

Protecting Brand requires various registrations that will state that the property belongs to a respective business and any misuse of that property by an outsider will commence severe consequences ensuring the exercise of the Brand.

Domain Registration

A domain name helps us reach an IP address. It helps to reach a website without knowing the IP address. It is the first step towards registration as the majority of people search online for businesses, products, and services. Having a website with own brand name is a must for all the businesses using an appropriate domain name that is short, easy to remember, original, easy to spell and most importantly synonymous with the brand name. Most popular domain names ending with .com or .net that are used for companies and networks may be replaced by .in or .co.in. To protect your brand from the beginning, a business should carefully register their domains that can be purchased on many websites like Go daddy etc.

Trademark Registration

A trademark is a calling card for a business, it is basically a word or phrase or a symbol or maybe a combination that identifies and distinguishes the source of the goods of one party from those of others which has to distinctive from the established trademarks. For e.g., logos of apple or Mercedes or any company cannot be copied or used. Only the owners of the trademark are entitled to the exclusive rights over the brand. It is one of the most important ways to protect your brand and should not be delayed. Many entrepreneurs think that mere registration of the business or trade name would protect their brand, but that does not provide registration to their logos. Hence it is necessary to register the trade name as a trademark. Trademark registration allows business to sue anyone who tries to copy or steal their brand in any form.

Copyright Registration

This registration is mandatory for anyone in the field of art. It gives an exclusive protection for your creativity and no legal action can be taken if your content is not copyrighted. This can be understood with examples, JK Rowling the author of famous Harry Potter series, she could sell the movie rights to Warner Brother for 1 million pounds and earned royalty income only because she had copyrighted her books from the initial stage.  Copyright can be afforded for literary, dramatic, musical and artistic works and producers of cinematograph films and sound recordings. If the brand has a unique logo with artistic characteristics, then the logo of the business can also be copyrighted to obtain additional brand registration, under the law
